1. Acceptance of Terms

By accessing or using Focuspilot ("the Service"), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a school, district, or organization, you represent that you have the authority to bind that entity to these terms.

If you do not agree to these terms, you may not use the Service. Continued use of the Service after any changes to these terms constitutes acceptance of the updated terms.

2. Service Description

Focuspilot is a classroom management platform provided by Viafocus AB. It consists of:

• A Chrome browser extension deployed on student devices via Google Admin Console

• A web-based teacher dashboard for real-time classroom monitoring

• A school administration panel for policy configuration

• An AI-powered lesson creation and quiz platform

The Service is designed exclusively for educational use in school settings.

3. Eligibility and Accounts

• The Service is available to schools, educational institutions, and authorized educators

• School administrators are responsible for creating and managing teacher and student accounts

• Student accounts are provisioned by the school — students do not create accounts independently

• You must provide accurate and complete information when setting up an account

• You are responsible for maintaining the security of your account credentials

4. Acceptable Use

You agree to use the Service only for its intended educational purpose. You may not:

• Use the Service for any purpose outside of classroom management and education

• Monitor students outside of designated school hours or school-managed sessions

• Attempt to access data belonging to other schools or organizations

• Reverse engineer, decompile, or attempt to extract the source code of the Service

• Use the Service to harass, intimidate, or unfairly target individual students

• Share screenshots or student data with unauthorized third parties

• Use automated tools to scrape or collect data from the Service

5. School Responsibilities

Schools deploying Focuspilot agree to the following responsibilities:

• Obtain necessary consent from parents or guardians as required by applicable law

• Deploy the extension only on school-managed devices used for educational purposes

• Ensure teachers use monitoring tools appropriately and in accordance with school policy

• Maintain accurate student and class rosters within the platform

• Notify Viafocus promptly of any suspected security incidents or data breaches

• Comply with all applicable local, national, and international laws regarding student data

6. Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is the property of Viafocus AB and is protected by copyright and intellectual property laws.

• Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service

• Content created by teachers using our lesson tools remains the intellectual property of the teacher

• You may not reproduce, distribute, or create derivative works from the Service without written permission

• The Viafocus and Focuspilot names, logos, and branding are trademarks of Viafocus AB

7. Payment and Subscription

• Pricing is based on the plan selected at the time of purchase

• Subscriptions are billed annually or as specified in your agreement

• Payment is due at the start of each billing period

• Schools with active subscriptions receive all updates and new features at no extra cost

• We reserve the right to change pricing with 60 days written notice before your next renewal

• Refunds are handled on a case-by-case basis — contact support@viafocus.com for requests

8. Service Availability

We strive to maintain high availability of the Service. However:

• We do not guarantee 100% uptime — planned maintenance will be communicated in advance

• We are not liable for interruptions caused by factors outside our control (internet outages, device issues, etc.)

• We will make reasonable efforts to resolve service disruptions promptly

• Critical security updates may require immediate maintenance without prior notice

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and protect student data. Key points:

• Student data is processed solely for the educational purpose described in our Privacy Policy

• We comply with GDPR, FERPA, and COPPA as detailed in our Privacy Policy

• Schools may request a Data Processing Agreement (DPA) at any time

• Upon termination, schools may request export or deletion of all their data

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind, express or implied

• Viafocus AB shall not be liable for any indirect, incidental, special, or consequential damages

• Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim

• We are not responsible for decisions made by teachers or schools based on data provided by the Service

11. Termination

• Schools may cancel their subscription at any time — access continues until the end of the billing period

• We may suspend or terminate accounts that violate these terms, with notice where possible

• Upon termination, we will retain data for 30 days to allow for export, then delete it

• Provisions regarding intellectual property, liability, and governing law survive termination

12. Changes to These Terms

We may update these Terms of Service to reflect changes in our practices, legal requirements, or the Service itself. We will notify schools of material changes via email at least 30 days before they take effect. The effective date at the top of this page will be updated accordingly.

13. Governing Law and Disputes

These terms are governed by the laws of Sweden. Any disputes arising from these terms or the use of the Service shall be resolved in the courts of Göteborg, Sweden.

For schools outside of Sweden, we will make reasonable efforts to resolve disputes amicably before initiating legal proceedings.
